Sales Terms & Conditions: • Companies and individual could participate in this auction. • Buyer can request for a site visit via email by attaching a copy of the commercial registration and ID cards of visitors. Email request should be sent to saladawi@tigergroup.com or call on +92771252. • The vehicle is sold “As Is, Where Is” without any warranty or guarantee as to the merchantability, description, quality, condition or fitness for any purpose nor is there any other warranty, expressed or implied. • The listed quantities are believed to be an accurate representation of the available assets. However, it is the Bidder's responsibility to verify the exact quantities and photos at the time of visit or inspection. Any queries should be raised and clarified via written email addressed to saladawi@tigergroup.com prior submitting the bid. • Pictures and details of the sale items are provided on the platform. However, Bidders are responsible for submitting their bids based on the actual stock and condition verified during their inspection. • The bid offer and signed bid documents shall remain valid for a minimum of 30 days from the date of bid submission and if needed the seller reserves their right to notify the bidders for required extension. • Bidders are required to submit their offers each sale lot in its entirety. Bid for partial quantities or individual items within a lot will not be accepted. However, the seller has full authority to decide upon any partial sale should there be an offer for partial quantity/item as needed. The seller retains full and final authority to select the successful bidder. • Buyer shall strictly adhere and comply to the laws and regulations as mandated by Environmental authorities/ Be’ah in handling, transporting, recycling and safe disposal of designated waste items sold and shall provide the buyer the proof for record, where applicable. • The Seller is not responsible for any loss or impact due to force majeure or due to any natural causes experienced by the Buyer during the sale & removal of sold goods. • Seller has all the right to either accept or reject, cancel any or all the bids without providing any reasons. • By submitting bid offer, buyer is understanding and accepting all terms and conditions listed herewith. • Please note IVMS & DFMS devices are already installed in these Vehicles, it will be removed prior to sale. At the time of inspection by various buyers, kindly be aware these devices are not included in Sale for these Vehicles. Bid deposit • Bid deposit / guarantee cheque: Interested bidders shall submit a guarantee cheque as per the auction announcement. Guarantee deposit / cheque for successful buyer will be refunded only after complying with all sale terms and conditions including materials removal and Mulkiya changes/transfer to the buyer. The Seller reserves the right to forfeit the guarantee deposit in the event : - If the qualified and successful bidder upon company’s notification within 30 days regardless of the ranking after auction closing refuses to complete the purchase by making the full payment within the due date as per TAX invoices and does not honor their submitted bid in compliance with the Conditions of Bid. - Buyer exceeds the allowed time for materials removal and Mulkiya change/transfer. - Damage to the seller asset while materials removal. In other cases, guarantee deposit/cheque will be refund once the sale cycle is completed, however seller has the right to hold the guarantee cheque. Mulkiya Transfer: • Bidder to note that the equipment/vehicle’s registration status (Mulkiya) may or may not have expired at the time of sale and hence bidder shall bear any and all expenses for renewal/name transfer including all other charges applicable for Mulkiya renewal delays with ROP. Selling party will not be responsible for any cost implications with regards to collection, repairs, renewal and transfer of ownership with ROP – Traffic Dept. and any other cost related to this matter. As the vehicles are sold on “As is and Where is “basis, Buyer must bear all expenses for vehicle repair and make the vehicle ready to pass the inspection/ test as needed. • Upon collection of sold equipment’s/vehicles, the Buyer shall perform the required formalities with ROP authorities for ownership transfer within a maximum period of (10 days) ten days after from the site. Failing to perform the ownership transfer within the above-mentioned period will result in penalty deductions of OMR 2 (Two Omani Rials) from the guaranteed amount for each day of delay beyond the above specified period, and up to a maximum of ten (10) working days. After the due date, the Seller reserve all the right to cancel the registration in ROP system at buyer's expenses. • Buyer to note that no claims shall be accepted by the seller in case of any vehicle/equipment found to be un- fit for ROP passing. Such cases shall have no impact on the concluded sale of such vehicle/equipment’s and the terms & conditions associated. Under such condition, vehicle/equipment’s shall be cancelled from ROP system. Payments: • Successful bidder shall make the full payment with 5% VAT and 5% buyer fee plus vat within 7 days of award notification. No refund will be made under any circumstances and no adjustment will be made on sold price for any reasons. • Successful Buyer shall make the full payment through wire transfer to the account details provided in the form of TAX invoice for both sale value and buyer fee. Buyer shall only collect the sold items upon confirmation on receipt of full payment and the clearance from the Seller. Materials Collection period: • Allowable duration of collection and to clear the yard with acceptable housekeeping 5 days from the permission to start. Collection to commence only after the entry permission is granted in writing. Buyer is not allowed to enter or allowed start removal without the presence of seller store representative. If the buyer exceeds the allotted time given for removal, seller has the authority to charge the buyer for the damages caused or levy additional fee for extended storage or the cost for any means necessary to clear the sold items and such actions can be taken at the sole discretion of the seller as necessary. Loadout: • Sold items shall be lifted from Seller’s store (ex-works). Preparing the goods, demolition, Lifting, handling & Transportation of sold materials from Seller yard shall be in Buyer’s cost & scope. • No loadout assistance available at Seller location. Buyer will be responsible for all fees, permits, incidental costs, food/accommodation, fuel and logistics associated with loadout. • It is buyer’s responsibility to obtain necessary permits from authorities for the transport of sold items as applicable. It is buyer’s responsibility to necessary permits and custom clearance for transport of these goods within and outside of Oman as applicable. • The Buyer shall arrange standard and good quality personal protective equipment (“PPE”) to all the personnel involved in collection including cover-all, safety boots, Goggles, hard hats, protective gloves etc. No personal will be allowed entry in to the seller premises without the mentioned PPE’s. • All the Buyer’s crew members involved in the material collection shall be legally permitted to perform work in Oman with valid visas and residence cards. Buyer shall be fully responsible and be accountable for any legal violation or consequences arises on the part of legality of manpower engaged by the buyer during the collection and removal. • It is the responsibility of the Buyer to completely remove the sold items as per sale (within the sale lot) and leave the Site clean from any waste or trash with acceptable level of housekeeping. • The collection of the sold item shall be within the company operating hours. No work will be permitted outside of the store working hours. • In case the IVMS device found available in the vehicle after loading, Buyer must return the same to the seller.
